The broadcast and public performance of music
In order to play any form of music in your venue, you are obliged to pay licensing fees that will cover your venue for the broadcast of music or sound recordings in a public performance environment. Public performance is the playing of a sound recording or the exhibition of a music video in public (i.e. a non-domestic environment). This includes on-hold telephone music. Licensing fees are payable by venues regardless of the type of music played.
The minute your venue or business plays CDs, vinyl, cassettes, or music videos, you become eligible to pay licensing fees. Licensing bodies are active in your marketplace. Below are the different options available for licensing venues and businesses that broadcast music:
1. Phonographic Performance Company Australia (PPCA) - Grants licenses for the broadcast and public performance of the recording and distributes to record labels, recording artists or the copyright holder.
2. Australian Performance Rights Association (APRA) - Grants licenses for the broadcast and public performance rights of the musical work and distributes to songwriters and their publishers.
3. SBA Public Performance License – Grants licenses for the broadcast and public performance of the recording in dining areas (restaurants & cafés) and distributes to record labels, recording artists or the copyright holder. This is a direct alternative to PPCA’s Tariff R License.
The practical effect of this distinction is that the broadcast or public performance of a recording usually requires two licenses - one from APRA and one from PPCA (or SBA). The reproduction and duplication of music
Under licensing laws, anyone manufacturing, reproducing or duplicating a recorded audio or video track must obtain the right to do so. There are two licensing bodies that grant permission for the reproduction of sound recordings and music videos:
1. Australasian Mechanical Copyright Owners Society (AMCOS) - Grants permission for the reproduction of musical works.
2. Australian Record Industry Association (ARIA) - Grants permission to individuals and organizations for the reproduction of the sound recording, where it is authorized to do so.
Abiding by the copyright laws of Australia, SBA Music are holders of these licensing agreements. This enables us to provide you with legal and legitimate recordings while also respecting the rights of music publishers and recording artists. SBA also hold individual licenses with all major record companies for the reproduction of music videos.
Please note that unless specified, the prices offered by SBA Music do not include APRA and PPCA licensing fees.
